Driveways & Landscaping Impact TVPOA Roadways

As is true of any construction in our subdivision, driveways are subject to prior review and approval by our Supervising Architect, on plans that show location and material.

 

Unfortunately, over the last few years some TVPOA homeowners have installed "hard driveways," including concrete or paver constructions, either to replace gravel or chip-and-seal driveways or as part of a new-home construction, without first obtaining approval from our Supervising Architect. In addition, some homeowners have extended landscaping beyond property lines into the TVPOA roadway.

 

Such actions are impermissible under the TVPOA's Construction Guidelines for Homeowners and Builders. These unapproved constructions have also caused water drainage problems and road surface erosion. The erosion occurs when water is diverted from natural swales adjacent to the road surface, into the road surface itself.



Members of the Architectural and Road Committees will be contacting owners whose existing conditions are out of compliance with TVPOA requirements and where the noncompliance is causing drainage issues and/or road erosion.

 

Maintaining the natural drainage swale along a TVPOA roadway is, in general, a homeowners' association responsibility. But repairing damage caused by driveway construction or landscaping that extends into the TVPOA roadway is a homeowner's responsibility. We will be seeking agreed remedial steps with each non-complying homeowner on a case-by-case basis. Our goal is to have all remedial action completed before we begin the new chip and seal paving.
